Program Description:

TEXcess, our Employers Excess Indemnity Program provides excess coverage over an Occupational Injury Benefit Plan and liability protection for employers' indemnity.

TEXcess is written on Safety National admitted paper. Our broad coverage form addresses inconsistencies with current forms now available in the market. Our policy combines all Occupational Injury Benefits and Employer Liability coverages into one form. We provide seamless implementation with ERISA Occupational Injury Benefit plans including enrollment services. Arbitration provisions are included to limit exposure and program expenses.

Coverage Enhancements:

First dollar defense expense recovery is available by endorsement.

Standard ERISA Occupational Injury Benefit Plan is available.

Employer's own Plan may be used at higher SIRs.

Other States Coverage is available on a deductible basis.

Broad Form Named Insured wording covers all affiliates.

Occupational Disease is covered on an occurrence basis, not per employee.

Coverage for infectious diseases is provided.

Coverage extends for third party liability for actual damages sustained.

Benefit periods up to 156 weeks.

Deposit & minimum premium (90%) provisions will apply.

 

Policy Limits Available:

Per Person Limit: Up to $5,000,000

Per Occurrence Limit: Up to $10,000,000

Policy Aggregate: None or Up to $25,000,000

 

Self Insured Retention:

Minimum retention of $100,000

Claims Administration Services:

All claims will be handled on an unbundled basis through Third Party Administrators. Self-administration is available with prior approval. Employers will have a separate contract with the TPAs to maximize service flexibility and cash management options. Safety National will provide "best practices" oversight on all TPAs and will conduct audits to verify that service standards are maintained.

Loss Prevention Services:

Loss prevention services are available upon request. Service can include on-site consulting, safety training, and safety plan development.

Marketing Plan:

Program will be available to all licensed agents in Texas via an exclusive wholesale agent. Safety National has appointed Jerry Murphy of the Colemont Insurance Brokers of Texas, LP to act as our exclusive wholesaler for this program. Colemont will be providing the following services: review of current benefit plan to determine compliance with plan design; determination of arbitration protocols; and, assessment of current plan structure versus limits needed.

Competitive retail commission is included in the program.
